Welcome to TeenBack. These Terms of Service ("Terms") govern your access to and use of the TeenBack website, SMS messaging system, email communications, and all related services (collectively, the "Service"). Please read these Terms carefully. By accessing or using the Service, you accept and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service immediately.
1. ELIGIBILITY
1.1 Teen Users (Ages 13–17)
TeenBack may only be used by minors with verifiable parental or guardian consent. Parents or guardians must complete the consent process during registration.
1.2 Users Under 13
TeenBack does not knowingly allow use by children under age 13. If we discover such use, the account will be immediately deleted.
1.3 Adult Users
Parents, guardians, educators, schools, and districts may create accounts and manage access for minors.
1.4 Geographic and Legal Compliance
Users are responsible for ensuring the Service is lawful in their region. TeenBack may restrict access based on local regulations.
2. DESCRIPTION OF THE SERVICE
TeenBack provides automated preventive support related to gambling, vaping, and drinking behaviors through SMS texts, email, and other digital tools. Messaging frequency depends on the selected plan. Messages may be triggered by time-based schedules or by user-initiated keywords such as “PAUSE,” “HELP,” or “TALK.”
The Service is not a therapeutic platform and does not replace medical professionals, counselors, or emergency services.
3. NO MEDICAL OR EMERGENCY SERVICES
TeenBack does not provide medical, psychological, therapeutic, diagnostic, counseling, or crisis care.
Nothing in the Service should be considered licensed professional advice.
The Service does not monitor users in real time and cannot intervene in emergencies.
If a user is in immediate danger or experiencing a crisis, they must contact 911 or emergency services.
TeenBack does not guarantee prevention of harmful behavior, relapse, addiction, or personal outcomes.
4. ACCOUNT REGISTRATION AND RESPONSIBILITIES
Users must provide accurate and current registration information.
Parents or institutions registering minors confirm they are legally authorized to do so.
Users agree not to impersonate others or provide false ages.
Users are responsible for safeguarding login credentials.
TeenBack may terminate accounts that violate these Terms or pose safety concerns.
5. CONSENT TO SMS AND EMAIL COMMUNICATIONS
By using the Service, users consent to receive recurring automated SMS and email communications.
Standard carrier rates may apply.
Message frequency depends on chosen tiers (4, 12, or up to 24 per day).
Users may stop messages at any time by texting STOP.
Parents may opt to receive copies of messages sent to their registered teens.
TeenBack is not responsible for carrier delays or message failures.
6. PAYMENT, BILLING, AND SUBSCRIPTIONS
Some TeenBack plans require payment.
Subscription fees and renewal dates appear at checkout.
Subscriptions renew automatically unless canceled.
Prices may change with notice.
Refunds are granted solely at TeenBack’s discretion unless required by law.
7. ACCEPTABLE USE POLICY
Users agree not to:
• Use the Service unlawfully or harmfully
• Register minors without legal authority
• Reverse-engineer or disrupt the platform
• Harass or misuse support channels
• Use bots or automated systems
• Misuse the Service to surveil minors
• Interfere with system stability
TeenBack may suspend accounts violating these rules.
8. PRIVACY AND DATA USE
TeenBack collects personal information solely to operate and improve the Service. Full details appear in the Privacy Policy. Data collected may include: name, mobile number, email, date of birth, messaging preferences, and parent/guardian contact.
TeenBack does not sell personal data, use it for advertising, or share it with third-party marketers.
9. PARENTAL, GUARDIAN, AND SCHOOL CONSENT
Parents or guardians registering minors confirm they have lawful authority to give consent.
Schools and districts confirm they have administrative approval to enroll students.
TeenBack may request additional verification when needed.
Accounts may be suspended if consent cannot be validated.
10. SCHOOL AND DISTRICT USE
Schools agree to comply with FERPA, COPPA, and other applicable laws.
A designated representative must oversee implementation.
TeenBack is not responsible for school disciplinary actions.
TeenBack data may not be used for punishment or academics.
11. INTELLECTUAL PROPERTY
All content, messaging, code, design, and templates belong to TeenBack and are protected by intellectual property laws. Users may not copy or distribute content without permission.
12. DISCLAIMERS
TeenBack provides the Service “as is” without warranties of any kind.
TeenBack does not guarantee:
• Prevention of addictive behaviors
• Continuous or error-free operation
• Delivery of every message
• Specific outcomes
TeenBack is not responsible for carrier failures or technical disruptions.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, TeenBack is not liable for indirect, incidental, special, or consequential damages, including addiction outcomes, emotional distress, lost data, missed messages, system outages, carrier failures, unauthorized access, or harm resulting from use of the Service.
If liability is imposed, it is limited to the amount paid in the last 12 months.
14. INDEMNIFICATION
Users agree to indemnify TeenBack against claims, damages, losses, or liabilities resulting from misuse of the Service, violation of these Terms, false registration of a minor, or violation of applicable laws.
15. TERMINATION
TeenBack may suspend or terminate accounts for violations, safety risks, or legal compliance.
Users may discontinue use by canceling or texting STOP.
16. INTERNATIONAL USERS
International users must comply with local data protection laws. TeenBack may restrict the Service in certain regions.
17. MODIFICATIONS TO THE SERVICE
TeenBack may modify or discontinue any part of the Service at any time with or without notice.
18. GOVERNING LAW
These Terms are governed by the laws of the State of New York. Disputes shall be resolved in courts located in New York County, New York.
